WestJet faces allegations of swapping out faulty planes to evade compensating passengers after flight cancellations, sparking significant controversy and calls for clarification from the airline.
WestJet's Alleged Compensation Evasion Tactics
WestJet has come under fire for allegedly employing a clever tactic to avoid compensating passengers following flight cancellations: swapping their aircraft for a faulty one, cancelling the flight, and then blaming "unforeseen maintenance." Under Canadian aviation passenger protection regulations, airlines are required to provide cash compensation for significant delays and cancellations that are within their control.
However, there’s a significant loophole: if the disruption is due to "unforeseen maintenance for safety reasons," the airline can sidestep compensation. An investigation by CBC Go Public suggests that WestJet might be creatively exploiting this clause.
The Specific Case
The incident involves a couple returning from Los Cabos, Mexico, to Canada on a WestJet flight. Their flight was cancelled, resulting in a delay of approximately 16 hours. When they sought compensation, WestJet refused, citing "unforeseen aircraft maintenance" for "safety purposes." While they may have a point, this does little to encourage Canadian airlines to be more proactive about aircraft maintenance.
Flight data reveals an even more intriguing story. The original aircraft assigned to the flight was swapped out at the same time the flight was cancelled. The original plane continued to operate on a different route, while the replacement aircraft was taken out of service for maintenance.
Is This a Pattern?
CBC's investigation didn’t stop at just one flight. They uncovered dozens of similar cases, including instances where tail numbers were swapped to a grounded aircraft right before a cancellation, followed by a refusal to compensate based on maintenance claims. The principle behind the exemption from compensation for maintenance is intended to protect airlines from penalties for sudden safety issues.

However, this is quite different from taking a flight that could operate with one aircraft, swapping it for a broken one, cancelling the flight, and then saying, "Sorry, unforeseen maintenance, no compensation for you." If this is indeed the case, I hope WestJet faces serious consequences.
WestJet's Explanation Lacks Conviction
WestJet has not provided a direct answer regarding this specific situation, offering only a general explanation: "Aircraft are sometimes reassigned to minimize the impact of disruptions." While this is true, it does not address the critical question: Why are flights being switched to grounded aircraft, and then immediately cancelled?
The Problem with Airline Compensation
I’m not naive about airline compensation claims. They have every incentive to frame delays and cancellations in the most favorable light for themselves. If a cancellation is "within their control," they may be required to compensate. If it involves "safety maintenance," they may not have to pay. This creates a clear issue with incentives.
Passengers often have very little information to act upon. Airlines maintain complete records of their operations. Passengers receive a denial notice and must either accept it or spend months or even years navigating the appeals process. This is not a truly consumer-friendly system.
Conclusion
WestJet is accused of using aircraft swaps to avoid compensating passengers after flight cancellations. The accusation is straightforward: assigning a flight to a broken plane at the last minute, cancelling the flight, and then denying compensation to passengers by citing unforeseen maintenance. WestJet may have a better explanation, but "aircraft are sometimes reassigned" is hardly convincing. If this is the case, regulators should take serious action.
